Terms and conditions

§1 General Provisions

1. The Monolitz online store, available at www.monolitz.com, conducts retail sales of personalized products via the Internet, based on these Terms and Conditions.
2. The owner of the Store is Monolitz Paweł Walczak, located at Olszanka 55, 23-465 Turobin, NIP 7122467346, email address: kontakt@monolitz.com.
3. These regulations are intended for Consumers and define the rules of using the online store and the terms and conditions of concluding sales contracts with the Customer remotely via the store.
4. The regulations are an integral part of the sales contract concluded with the Customer.

§2 Definitions

The terms used in the regulations mean:

1. Customer – an adult individual, company, or organization capable of entering into contracts.
2. Personalized Product – a product customized to the individual needs of the Customer via the Store’s Configurator.

§3 Personalized Products

1. The Store offers personalized products, which are individually configured by each Customer.
2. Personalized products are excluded from the right to withdraw from the contract due to their individual character.

§4 Product Offer

1. All products offered in the store are brand new, free from physical and legal defects, and have been legally introduced to the Polish market.
2. Personalized products are composed by the Customer from available elements using the Configurator.

§5 Orders

1. Orders are accepted exclusively through the online store.
2. To process an order, it is necessary to provide data enabling the delivery of the product.
3. The Store confirms the acceptance of the order by email and has the right to refuse to execute the order in case of non-realization of payment resulting from the order.

§6 Payments

1. The Customer can choose the following forms of payment: online transfer, direct transfer to the company’s account, credit cards, Blik.
2. In the case of card payments, refunds are made to the bank account associated with the Customer’s payment card.

§7 Shipping and Delivery

1. Ordered products are shipped via a courier company.

§8 Right to Withdraw from the Contract

1. According to Art. 38 item 3 of the Consumer Rights Act, the right to withdraw from the contract without giving a reason within 14 days does not apply to contracts for the supply of non-prefabricated goods, produced according to the consumer’s specification or serving to satisfy his individualized needs.

§9 Complaints

1. Complaints concerning personalized products will be considered individually.
2. In case of a complaint, the Customer should provide proof of purchase and a description of the discrepancy.

§10 Personal Data Protection

1. Customers’ personal data are protected in accordance with the applicable personal data protection regulations.

§11 Intellectual Property

1. All materials presented in the Store, including product designs, are protected by copyright and cannot be used without the Store’s consent.

§12 Entry into Force and Amendments to the Regulations

1. The regulations come into force on the day of publication on the Store’s website.
2. The Store reserves the right to make changes to the regulations.

§13 Final Provisions

1. Any disputes arising from the performance of sales contracts will be settled in the first instance through negotiation, with the intention of amicable resolution, in accordance with Polish law.
2. In matters not regulated by these regulations, the provisions of the Civil Code, the Act on Providing Services by Electronic Means, and other relevant provisions of Polish law shall apply.
